Licensee: Anyone who receives the Product under this Agreement
Grant of License
The Licensor grants the Licensee a limited, non-exclusive, non-transferable license to install and use the Product in its unmodified binary form under the conditions of this Agreement. Usage is limited to the launcher provided as part of the Product.
The Licensee may use the Product and its components only through the user interface accessible via the provided launcher. Sharing the license key or making the Product accessible to others is prohibited, especially through automated means. This includes integrating the Product into the backend of a web service to allow others to submit calculations or use the Product indirectly.
However, the Licensee is permitted to distribute, openly share, or use the results of authorized calculations for commercial purposes, provided these results were produced by the Licensee in compliance with this Agreement and applicable law.
The exclusive rights (pursuant to Section 24 (1), second sentence of the Austrian Copyright Act) remain with the Licensor. The source code is not provided, and the Licensor has no obligation to supply it.
After activating the Product with a valid license key, some features may remain disabled. The Licensee must not attempt to access disabled features without a valid, active license key issued by the Licensor and registered to the Licensee. Unlocking different feature sets (e.g., “classic,” “pro”) may require purchasing time-limited keys or subscriptions. Additional terms of use specific to the purchased key may apply in addition to this Agreement.
Responsibilities of the Licensee
The Licensee is responsible for providing the necessary electronic infrastructure to use the Product, including appropriate software and hardware. The Licensor is not obligated to offer information or advice regarding these requirements.
The Licensee must avoid any actions that could harm or disrupt the Licensor's technical services. Such actions may result in legal action. In the event of unlawful conduct by the Licensee, the Licensor reserves the right to block the Licensee's access.
Automated scraping of information from the Product's user interface or memory is expressly prohibited. Results should only be exported using the export and save options provided within the Product.
The Licensee is not permitted to decompile, reverse engineer, or modify the Product without the Licensor's consent, except as allowed by law. Removing or altering any markings on the Product, including copyright notices, trademarks, serial numbers, or similar identifiers, is prohibited.
Limitation of Liability
The Licensor is not liable for slight negligence. Liability is limited to the amount of the Product license fees paid by the Licensee. The Licensor accepts no liability for any improper use of the Product by the Licensee.
Governing Law and Jurisdiction
This Agreement is governed by Austrian law. The application of the UN Convention on Contracts for the International Sale of Goods is excluded. The exclusive place of jurisdiction is the competent court in Vienna, Austria (Vienna Commercial Court).
